Terms and Conditions for Swing House Golf Sims
Welcome to Swing House Golf Sims! By using our facilities and services, you agree to abide by the following terms and conditions in full. If you do not accept all terms, please do not use the Golf Indoor Trackman Simulator.
1. Booking and Reservations
1.1 Booking Process: Reservations can be made online, via mobile app, or in-person.
1.2 Payment: Full payment is required at booking.
1.3 Cancellations and Refunds: Cancellations must be made at least 24 hours in advance for a full refund; no refunds for cancellations within 24 hours.
2. General
2.1 Introduction: These terms govern the use of the Golf Indoor Trackman Simulator and all services provided at Swing House.
2.2 Responsible Use: Patrons must use the facility and equipment responsibly and follow all provided safety guidelines. Participation in activities is voluntary and assumes all associated risks.
3. Rules of Conduct
Patrons agree to read and comply with all rules, warnings, and instructions provided by Swing House staff. Non-compliance may result in removal from the premises without refund.
4. Age Requirements
Customers must be at least 18 years old to purchase services. Minors must be accompanied by an adult at all times on the premises.
5. Assumption of Risk
Participating in indoor golf and related activities carries inherent risks, including property damage, serious injury, or death. Patrons assume full responsibility for these risks, regardless of cause.
6. Release of Liability
Patrons release Swing House and its affiliates from any liability for loss, damage, or injury incurred during participation in activities, including those resulting from negligence.
7. Indemnification
Patrons agree to indemnify Swing House and its staff from any loss or costs incurred due to their participation in activities, whether caused by negligence or otherwise.
8. Payment for Damages
Patrons are responsible for paying for any damages to the facility or equipment resulting from their actions or those of minors under their supervision.
9. Medical Authorization
In case of injury, patrons grant Swing House permission to arrange necessary medical treatment and acknowledge financial responsibility for such treatment.
10. Choice of Law
This agreement is governed by the laws of Minnesota. Any disputes will be resolved in Minnesota courts.
11. Severability
If any provision is found to be invalid, the remaining provisions will remain in effect. If a provision can be limited to be enforceable, it will be interpreted as such.
12. Emergency Situations
In emergencies, patrons must follow posted instructions and exit the facility in an orderly manner.
13. Acknowledgment of Understanding
By participating, patrons acknowledge they have read this agreement, understand its terms, and voluntarily agree to them, relinquishing substantial rights, including the right to sue Swing House.
14. Parent/Guardian Waiver for Minors
Parents or guardians of minors agree to these terms on the minor’s behalf and indemnify Swing House against any claims related to the minor's participation.
15. Equipment Use
15.1 Trackman Simulators: Patrons must use the simulators safely and respectfully; any damage from misuse is the patron's responsibility.
15.2 Footwear: Only non-marking indoor sports shoes are permitted; no golf spikes or outdoor shoes allowed.
15.3 Club Use: Patrons must bring clean clubs and may use their own balls, provided they are free of marks.
16. Conduct and Safety
16.1 No Smoking: Smoking is prohibited in the facility.
16.2 No alcohol or drug use on premises.
17. Liability
17.1 Liability Waiver: Patrons acknowledge participation is at their own risk and release Swing House from liability for injuries or damages.
17.2 Insurance: Personal liability insurance is recommended.
18. Commercial Use
18.1 To ensure a fair and professional experience for all our customers, we do not allow unauthorized
commercial activities, including golf instruction, at our facility. This interferes with our ability to
offer high-quality instruction through our business and also raises liability concerns.
Any individual conducting golf instruction, coaching, or training sessions without prior written
approval from Swing House Golf Sims, LLC is in violation of our policies. Unauthorized
instruction or commercial use of our facility may result in immediate removal, restriction from
future use, and potential legal action. We reserve the right to charge an unauthorized instruction
fee equivalent to our standard lesson rate. Additionally, we are not responsible for any injuries,
claims, or disputes arising from unauthorized instruction, and individuals engaging in such
activities assume full responsibility for any consequences.
If you are a certified instructor interested in offering lessons at our facility, we are open to
discussing potential partnership opportunities. Please contact us to learn more about our
requirements and policies.
19. Privacy Policy
19.1 Data Collection: Personal information may be collected for bookings and marketing; it will not be shared with third parties.
19.2 Security: Measures are in place to protect personal information from misuse.
20. Changes to Terms and Conditions
20.1 Amendments: Swing House reserves the right to amend these terms. Patrons will be notified of any changes and must abide by the revised terms.
21. Memberships
The person who signs up for a membership must be present during the reservation. Sharing memberships or allowing others to use your codes will result in being charged the hourly rate & potential cancellation without refund of your membership.
